Nofonex Online Services provides specialized language, content, and digital services, including but not limited to:

• Native-level translation services
• Transcription of audio/video content
• Machine translation post-editing (MTPE)
• Proofreading and editing
• Entry
• Cadence/structure services
• Translation services
• Copywriting
• Subtitling
• Digital content creation and assistance
• Prompt engineering for story-telling, education materials, and business reports
• Content strategy and planning

3. User Accounts

3.1 Registration

To access certain features of our services, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

3.3 User Conduct

When using our services, you agree not to:

• Violate any applicable laws or regulations
• Infringe upon the rights of others
• Submit false or misleading information
• Upload or transmit viruses or malicious code

4. Orders and Payments

4.3 Payment Terms

Payment terms will be specified in your order confirmation or contract. We accept various payment methods including regular bank transfers, PayPal, Payoneer, Wise, Stripe, and cryptocurrency (MetaMask).

4.4 Late Payments

Late payments may result in service delays or suspension. We reserve the right to charge interest on overdue amounts at a rate of 1.5% per month.

5. Delivery and Revisions

5.1 Delivery

We strive to deliver all services within the agreed-upon timeframe. However, delivery times are estimates and may be affected by factors outside our control.

5.2 Acceptance

Upon delivery, you have 7 days to review the deliverables and request revisions. After this period, the deliverables will be deemed accepted.

5.3 Revisions

Reasonable revisions are included in our service as specified in your order or contract. Additional revisions may incur extra charges.

6. Intellectual Property

6.1 Client Materials

You retain all rights to the original content and materials you provide to us. By submitting materials, you grant us a non-exclusive license to use, reproduce, and modify these materials solely for the purpose of providing our services to you.

6.2 Deliverables

Upon full payment, you will receive ownership rights to the deliverables created specifically for you, except for any third-party elements that may be incorporated (such as stock images or licensed software).

6.3 Nofonex IP

We retain ownership of all methodologies, processes, techniques, ideas, concepts, trade secrets, and know-how used in creating the deliverables.

7. Confidentiality

We treat all client information and materials as confidential. We will not disclose your confidential information to third parties without your consent, except as required by law or as necessary to provide our services.

8. Limitation of Liability

To the maximum extent permitted by law, Nofonex shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use our services
• Any unauthorized access to or use of our servers and/or any personal information stored therein
• Any interruption or cessation of transmission to or from our services
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our services

Our total liability for any claims under these Terms shall not exceed the amount you paid us for the services in question.

9. Termination

We may terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use our services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our services after those revisions become effective, you agree to be bound by the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Nofonex is registered, without regard to its conflict of law provisions.
